The state doesn’t have to approve a name that is obscene and offensive, the court said.
The same man succeeded in 2004 in legally changing his name from “Snaphappy Fishsuit Mokiligon” to “Variable.” Back then, the Court of Appeals sided with the man, ruling that he could call himself anything he wanted as long as it wasn’t obscene, fraudulent or ridiculous. (Calling yourself “Variable” is not ridiculous, the court decided.)
The court cited an earlier Utah case that allowed a man to change his legal name to Santa Claus, despite the state’s objections that the name could “cause confusion” and that the man could avoid lawsuits because no one would want to go on record as having sued Santa Claus.
