Woman claims Wal-Mart discriminated against monkey

September 5, 2008

A real estate agent in Missouri has filed a lawsuit against local health officials and Wal-Mart, claiming they discriminated against her monkey.
Debby Rose of Springfield says she has an anxiety disorder and that her pet monkey — a 10-year-old bonnet macaque named Richard — calms her down so she doesn’t need medication. She says the monkey is a “service animal” and she regularly brings him to real estate closings as well as to stores, dental appointments, beauty parlors and restaurants.
But various businesses complained to county health authorities, who declared the animal a health hazard. So Rose sued under the Americans With Disabilities Act.
Rose says the animal poses no risk because he wears a diaper, showers every day and brushes his teeth. She says the county’s rules conflict with the state transportation department, which placed a restriction on her driver’s license saying she can’t drive unless the monkey is in the car.
