‘Rampant’ Sex in Jury Room Could Result in New Trial
December 23, 2008
A convicted murderer in St. Louis is demanding a new trial because jurors and sheriff’s deputies engaged in “rampant” sex during their deliberations.
The jurors deliberated for two days, during which they were sequestered at a hotel. One juror later told the judge that various jurors engaged in “scandalous and unspeakable” sex acts during that time.
“Sexual liberties by deputy sheriffs were rampant also,” the juror reported.
There is no law that specifically prohibits jurors or the court officials guarding them from making out on the job, but attorneys for Roberto Dunn, who was found guilty of stabbing his girlfriend’s mother, say it proves the jurors who convicted him didn’t take their responsibility seriously.
Lisa Stroup, a public defender, says she will ask the jurors to testify about their “unspeakable” acts. Judge Julian Bush will have a “complete picture” when he rules on the issue, notes prosecutor Rachel Smith.
