Rival Makers of Fart-Sound iPhone Apps Head to Court
February 19, 2009
Two rival companies that sell iPhone applications that produce farting noises are headed toward a flatulence showdown in a federal court in Denver.
The trouble began when Air-O-Matic, which makes the “Pull My Finger” app, demanded $50,000 from a rival called “iFart Mobile.” Air-O-Matic accused iFart of trademark infringement after it used the term “Pull My Finger” in a press release and a YouTube video.
But iFart fired back, asking the court for a declaratory judgment that it had done nothing wrong. iFart claims “Pull My Finger” can’t be trademarked because it’s common slang and a descriptive phrase.
Despite the recession, the flatulence app market is booming, with more than 75 different fart programs now available on the iPhone App Store, according to iFart.
